Chosen to hear the appeal of a lawsuit brought against Yoo by Jose Padilla, who was held for more than three years as an enemy combatant, were Ninth Circuit Judge Pamela Rymer, an appointee of President George H.W. Bush, along with Ninth Circuit Judge Raymond Fisher and Illinois U.S. District Court Judge Rebecca Pallmeyer, both appointees of President Bill Clinton.

Lawyers for John Yoo will make oral arguments Monday in the US Court, 9th Circuit in San Francisco in the case of Padilla v. Yoo. Three years ago, Jose Padilla won the right to sue John Yoo for damages inflicted upon him through Yoo's legal justification of torture. But the Obama administration is defending Yoo.
